2. Legal Penalties and Liability Under Section 512(f)

To be legally effective under the DMCA, your counter-notice must be a written communication sent to support@charmj.com containing the following elements:

  • Your Signature: A physical or digital electronic signature verifying your identity.
  • Identification of Removed Material: Identification of the specific material that has been removed or to which access has been disabled, along with the precise URL position where the material appeared before its removal.
  • Statement Under Penalty of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Consent to Jurisdiction: Your full name, physical mailing address, and telephone number, along with a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside the United States, that you consent to the jurisdiction of the Federal District Court for any judicial district in which Charmj may be found), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.

5. Post-Counter-Notice Logistics Framework

Upon receiving a valid counter-notification that satisfies all necessary legal prerequisites, Charmj will promptly forward a copy of the document to the original complaining party who filed the initial takedown request.

The DMCA provides that the removed or disabled material may be restored by us after 10 business days and up to 14 business days following receipt of the counter-notice, unless our designated agent receives official notification from the original complaining party that they have filed an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on our website system infrastructure.
